I looked at your site and, unless you are covered under 5(D)(1)(b), I would remove that offer from my website ASAP and maybe call the Ohio AG's office Monday and ask one of the lawyers there if it's ok or not. They aren't bad guys and will steer you in the right direction. When Dann was the AG, they made a point of shutting down a lot of charities not in compliance, and I don't think they have changed all that much since he left! I oversee ALL of the fundraising events for a registered 501(c)(3)and haven't seen anyone put up a betting pool like that... and we raise some pretty serious funds throughout the year.
